Welcome to Dopamine, a loyalty program that allows you to earn and redeem rewards through WhatsApp. By participating in the Dopamine Loyalty Program (“Program”), including scanning a QR code, generating or entering a code, or otherwise engaging with our services, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree with these Terms, please do not use the Program.

1. Acceptance of Terms

By accessing or using the Program, including but not limited to scanning a QR code, initiating a WhatsApp chat, generating or entering a code, or redeeming rewards, you confirm that you have read, understood, and agree to these Terms. We may update these Terms from time to time, and continued use of the Program after such updates constitutes your acceptance of the revised Terms. The latest version of the Terms will always be available at dopamine.app/terms.

2. Eligibility

To participate in the Program, you must:

• Be at least 21 years old, as per the age of majority in the UAE, or the age of majority in your jurisdiction, or have parental consent if under the applicable age.
• Have a valid WhatsApp account and a device capable of accessing WhatsApp.
• Reside in a region where the Program is offered.

3. Program Participation

• How It Works: The Program allows you to earn points, rewards, or benefits (“Rewards”) by completing qualifying actions, such as making purchases with participating brands, generating codes, or entering codes provided by Dopamine or its partners (“Partner Brands”).
• QR Code and WhatsApp: To join, you may scan a QR code to initiate a WhatsApp chat with Dopamine. You will receive a welcome message and may be prompted to generate or enter a code to participate.
• Rewards: Rewards are subject to availability and may have specific conditions, such as expiration dates or redemption limits, which will be communicated via WhatsApp or our website. Dopamine reserves the right to modify or discontinue Rewards at its discretion, with notice provided as required by applicable laws.

4. Consent to Promotional Messages

By participating in the Program, you expressly consent to receive promotional messages, offers, and updates from Dopamine and Partner Brands via WhatsApp, SMS, email, or other communication channels. These messages may include marketing content, special offers, and Program updates. You can opt out at any time by replying “STOP” to a WhatsApp message or following the unsubscribe instructions provided in other communications, as required by applicable laws, including UAE Federal Law No. 15 of 2020 on Consumer Protection. Opting out may limit your ability to fully participate in the Program.

5. Third-Party Services

The Program integrates with third-party platforms and services, such as messaging applications (e.g., WhatsApp), customer relationship management tools, and analytics providers, to deliver and enhance your experience. By using the Program, you acknowledge and agree that:

• Your data may be processed by these third-party services in accordance with their terms and privacy policies, which comply with applicable data protection laws.
• Dopamine is not responsible for the availability, functionality, or policies of third-party services, but we select partners that adhere to industry-standard data protection practices.
• You may need to agree to the terms of third-party services (e.g., WhatsApp’s Terms of Service) to use the Program fully.

6. Privacy and Data Use

Your privacy is important to us. By participating in the Program, you agree to the collection, use, and sharing of your personal information as outlined in our Privacy Policy, available at dopamine.app/privacy. We comply with applicable data protection laws, including UAE Federal Law No. 45 of 2021 on Personal Data Protection and, where relevant, international regulations such as the EU GDPR.

7. User Responsibilities

You agree to:

• Provide accurate and complete information when participating in the Program.
• Use the Program only for lawful purposes and in accordance with these Terms and applicable laws, including UAE Federal Decree-Law No. 14 of 2023 on Trading by Modern Technological Means.
• Not share, transfer, or misuse codes or Rewards, as they are personal and non-transferable.
• Notify us immediately if you suspect unauthorized use of your account or Rewards.

8. Intellectual Property

All content, trademarks, and materials related to the Program, including logos, designs, and messages, are the property of Dopamine or its licensors. You may not copy, reproduce, or distribute these materials without our prior written consent, as protected under UAE Federal Law No. 38 of 2021 on Copyrights and Neighboring Rights.

9. Limitation of Liability

To the fullest extent permitted by applicable law:

• The Program is provided “as is” without warranties of any kind, express or implied.
• Dopamine is not liable for any indirect, incidental, or consequential damages arising from your use of the Program, including but not limited to loss of Rewards, data, or profits.
• We do not guarantee the availability, accuracy, or functionality of the Program or third-party services.

10. Termination

We may suspend or terminate your participation in the Program at our discretion, including for:

• Violation of these Terms or applicable laws.
• Suspected fraud, abuse, or unauthorized use of the Program.
• Inactivity for a period specified in Program communications. If your participation is terminated, you may lose access to unredeemed Rewards, with notice provided as required by applicable laws.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of Sharjah, United Arab Emirates, without regard to conflict of law principles, except where local consumer protection laws in your jurisdiction mandate otherwise. Any disputes arising from these Terms will be resolved in the courts of Sharjah, United Arab Emirates, unless local laws require a different venue for consumer disputes.

12. Compliance with Local Laws

Dopamine strives to comply with all applicable local laws in the jurisdictions where the Program is offered, including consumer protection and data protection regulations. If any provision of these Terms conflicts with mandatory local laws, the local laws will prevail to the extent required.
